Plessy v Ferguson Prompt

My last post you saw was on the mock trail we held in class, Plessy v Ferguson. Just a quick overview of the case. Homer Plessy was 1/8 African American male who bought a first class ticket for a train ride. He was arrested and went to court to say that they were violating the 14th amendment. The Court decided to rule in favor of the state. I am posting this to talk about the dissenting argument.

First I would like to start by saying what a dissenting argument is. A dissenting opinion is an opinion filed by a judge who disagrees with the majority decision of the case. Judge Harlan was the only one only one of the justices to disagree with the majority opinion. Judge Harlan wrote this argument because he believed that if one day there is a similar case to this one he can voice his opinion and use this case as an example. And he was right his argument helped with the Brown v Education case in 1954.

I can see why Judge Harlan's argument at the time would be looked down upon because people didn't believe African Americans should have the same rights as whites. But in today's world I believe Harlan's argument would be the majority decision.
